Now that cannabis has become legal in many areas the impact is being felt on both construction companies and their workers. The rapid increase in building opportunities come with a steep learning curve. This has become a serious issue in California and other states and it requires, even demands that anyone involved stay up to date on current laws and the rapidly changing body of knowledge available.
The demand and requirements as they pertain to cultivation facilities since cannabis has been deemed legal in many areas means more room and more demand for educated builders. This increase in demand brings with it unique challenges. In one scenario a builder may be contracted to build a cultivation facility that requires greenhouses with both artificial and natural lighting. Any facility that calls for this will also demand an eye focused on the increased power requirements, water use, ventilation and heating demands. Most every cultivation facility builder may be requested to address security and that will require compliance with state laws along with local ordinance compliance. Cannabis Grow Builders knows that building in these spaces can be a challenge because many of these spaces are repurposed warehouses and abandoned retail spaces.
Another issue is cannabis continues to be listed as an illegal Schedule I drug by the U.S. Drug Enforcement Agency (DEA). Even though cannabis is legal in California, the federal government can seize property related to cannabis at any time. This rule applies nationally due to the fact that Federal Law supersedes state law and the fact that tax laws prohibit businesses from deducting expenses related to marijuana, which can result in exorbitant taxes and profit loss. This all makes financing a cannabis construction project difficult as banks aren’t usually willing to invest in a project that is possibly unprofitable and subject to forfeiture.
The laws governing legal cannabis are a moving target at best and constantly changing. Given that total cannabis production and consumption will near $10 billion in California it’s important to be able to navigate this ever changing industry and participate.
