Cannabis is one of the more tightly regulated industries in the nation. Understanding the level of regulation might make someone wonder how water use and wastewater disposal has been so ignored by so many for so long. In our industry water use and fertilization are critical to our long-term viability. In any agricultural setting the addition of fertilization to the mix means you will eventually deal with wastewater. In the case of indoor grow facilities that means complying with ever changing local wastewater regulations.
Since cannabis is still technically illegal at the federal level the Environmental Protection Agency’s (EPA) Clean Water Act may not currently apply to grow facilities. The other reality is when the laws change every facility will likely be compelled to fall within the rules from day one. The facilities we’ve worked with are in compliance with the federal rules from day one and that makes them ahead of the game. The 1972 EPA Clean Water Act established the basic structure that regulates the discharge of defined pollutants into the waters of the United States.
At the local level we’ve found regulations vary from state-to-state and even county-to-county. In California, water in most municipalities is a sought after and increasingly scarce commodity so conservation is critical. Wastewater, as it pertains to the cultivation of cannabis is an area where the application and understanding of the science has the potential to solve a myriad of issues in advance. The primary contaminants contained in cannabis wastewater include phosphates and nitrogen that exist in the runoff from nutrients applied to promote growth. Since these are typical from any horticulture operation, indoor or outdoor, their remediation prior to introduction to any municipal sewer system allows for compliance in many cases.
